SUBSCRIPTION AGREEMENT (“Agreement”)

IMPORTANT – By obtaining Membership, individuals and/or their parents/guardians expressly consent to the Member being fully bound by the Technical Regulations, Code of Conduct, Safeguarding Policies, Anti-Doping Rules, and all other official rules, directives, and regulations issued by Persatuan Silambam Asia Malaysia (Malaysia Association of Silambam Asia) (MASA).
Membership, benefits, and any insurance coverage offered by Persatuan Silambam Asia Malaysia (MASA) are valid only when the Member is training at registered clubs or organizations listed within the membership system or approved via manual application, participating in MASA-approved programmes, or attending MASA-sanctioned events.
1) Class Request:
If your location is not available on our booking platform and you are interested in starting Silambam classes at your location, please write to us at [email protected].
Please note that any costs, charges, facility rental fees, permits, or expenses related to the booking or usage of facilities at your location shall not be borne, reimbursed, or subsidized by Persatuan Silambam Asia Malaysia.
2) Refunds:
All payments made are strictly non-refundable and non-transferable under any circumstances. This includes absences, missed classes, personal vacations, or scheduling conflicts of students, parents, instructors, or teachers. Weekend classes conducted with a 1.5 to 2-hour duration are deemed sufficient to cover missed hours within the same month.
Persatuan Silambam Asia Malaysia reserves the absolute right to cancel any Silambam programme with insufficient registration up to one week before commencement. If a class is cancelled due to operational, logistical, or scheduling reasons, participants will be transferred to the next available class without additional charges.
If a class is cancelled by MASA due to instructor illness or facility unavailability, MASA will arrange a replacement class or issue credit hours redeemable for future training sessions.
3) Pricing:
Package options are available for purchase on our website.
Each package carries its own validity period starting from the date of the Member’s first enrolment.
* Please note that missed sessions or withdrawals during the package validity period are not eligible for refunds, credits, or extensions.
* Classes are not conducted on Public Holidays. No replacement classes or credit compensations will be issued for classes falling on Public Holidays.
Persatuan Silambam Asia Malaysia reserves the right, at its sole discretion, to adjust and revise fees at any time.
4) Membership:
The purchaser of a Persatuan Silambam Asia Malaysia Membership must agree to these Terms & Conditions at the point of purchase.
Any individual purchasing Membership on behalf of another person warrants that they have full authority and consent from the Member to do so and to accept these Terms & Conditions on their behalf.
Persatuan Silambam Asia Malaysia reserves the right to refuse, suspend, or cancel any Membership at its absolute discretion without the obligation to provide reason.
Membership Fees, Contributions, and Payments related to the World Silambam Association (WSA) are payable annually, strictly non-refundable, and non-transferable. Annual revisions may be implemented by the Executive Committee Members of Malaysia, with final approval by the Chairman of the WSA.
Membership begins on the date of purchase and automatically expires 12 months thereafter. Renewal is not guaranteed and remains subject to MASA’s approval.
A Member may terminate their Membership at any time by emailing [email protected], but no refunds (in full or partial) will be provided.
Persatuan Silambam Asia Malaysia reserves the right to rebrand or rename Membership products at any time.
Members may be required to present proof of Membership, such as a Membership Certificate, to access benefits.
Membership is strictly personal, non-transferable, and may not be reassigned, sold, or shared under any circumstances.
Individual Membership is valid only when associated with a MASA-affiliated club or organization. If a club ceases its affiliation with MASA, all memberships under that club will automatically lapse without refund. Affected Members may request a transfer to another MASA-affiliated club by contacting Membership Services.
MASA reserves the right to suspend or terminate Membership or benefits if the Member violates these Terms & Conditions or is reasonably suspected of misuse, misconduct, or actions detrimental to MASA.
MASA is not liable for refunds if Membership or associated benefits are suspended, withdrawn, or terminated.
MASA is not liable for delays or failure to fulfil obligations due to circumstances beyond its control, including natural disasters, government restrictions, pandemics, or force majeure events.
MASA may update Membership Terms & Conditions periodically. Members are encouraged to review these terms prior to renewal.
Membership benefits—including but not limited to discounts, priority access, digital content, insurance (where applicable), and legal support—are provided as stated by MASA. MASA may modify, replace, or withdraw benefits without notice.
Members must ensure their personal information remains accurate and updated via the membership system or manual forms.
MASA is not responsible for late delivery or non-delivery of physical documents due to postal or courier service delays.
5) Membership Data:
Persatuan Silambam Asia Malaysia collects personal information for Membership processing, service delivery, record maintenance, communication regarding Membership (including renewals), organisational development, and—where permission is given—sharing updates or information relevant to Members.
MASA may provide necessary information to approved service providers to facilitate Member-related services. Personal data will not be shared with unaffiliated third parties for marketing purposes.

6) Liability Waiver:
By booking classes, parents/guardians/participants acknowledge and consent to participation in Silambam activities and authorize emergency medical treatment when necessary. All participants understand and accept that they engage in physical activity at their own risk. MASA, its owners, employees, instructors, contractors, and affiliated organizations shall not be liable for any injury, illness, accident, loss, property damage, or death arising during any training session, event, tournament, seminar, workshop, camp, or MASA-organized activity.
This waiver applies even in cases involving alleged negligence, omissions, or errors by MASA or its representatives. Participants and/or their parents/guardians agree to indemnify and hold harmless MASA, its representatives, and affiliates from any claims, demands, liabilities, or legal actions brought by any party resulting from participation.
MASA prioritizes safety and reserves the right to remove any participant exhibiting bullying, misconduct, aggression, or disruptive behaviour, without refund.
7) Photography and Videos:
Participants and/or parents hereby consent that photographs or videos captured during MASA activities may be used by MASA for promotional, educational, or archival purposes. These materials remain the exclusive property of MASA and will not be distributed to third parties without consent. To opt out, email [email protected] with the subject “PHOTOGRAPHS AND VIDEOS”.
8) Silambam Uniforms or Silambam Equipment:
Official Silambam uniforms, orange Silambam T-shirts, or Silambam equipment may be purchased by emailing [email protected] with the subject “Silambam Uniform” or “Silambam Equipment”. Kindly specify the participant’s age, height, and required size.
9) Medical Conditions:
Parents/guardians must inform MASA of any medical conditions, injuries, allergies, or health considerations relevant to the participant by emailing [email protected] or disclosing it during the booking process.
10) Pandemic or Epidemic Situation:
In the event of government restrictions, public health measures, or emergencies (including COVID-19 or future pandemics/epidemics) that prevent physical classes from being conducted, all classes will be shifted to an online format. Purchased packages will continue to be utilized through these online sessions.
* Packages will continue to be consumed and deemed utilized regardless of the participant’s attendance or non-attendance at any sessions, programmes, or events facilitated, arranged, or organized by Persatuan Silambam Asia Malaysia. No extensions, credits, transfers, or refunds will be provided under any circumstances.
